DMCA Policy

JNPSoft and OptiCat (“JNPSoft and OptiCat,” “we,” or “our”) respect the intellectual property rights of others, and thus we expect our customers, users, and visitors (collectively and each individually, “users” or “user”) to comply with all applicable laws in such regard, including without limitation, U.S. copyright law and any other related legal protections. Users may not store any material or content on, or access, share, publish, or disseminate any material or content over any of our product or service offerings (“service”) that in any manner infringes upon third-party intellectual property rights.   In pursuit of this policy and pursuant to the Digital Millennium Copyright Act (“DMCA”), we will respond expeditiously to all proper claims of copyright infringement on our service that are reported to the designated DMCA agent identified below.  See this link for information concerning the DMCA:  https://www.copyright.gov/dmca/.

As part of this policy, JNPSoft and OptiCat may terminate a JNPSoft and OptiCat user account, in appropriate circumstances and pursuant to our discretion, held by a repeat infringer of a third-party’s copyright rights. The user infringer will be notified of any valid claim of infringement asserted relative to the DMCA process, and a first-time user offender will be required to acknowledge this policy and that any subsequent verified claims of infringement may result in that user’s termination from our service.   Should subsequent DMCA notification(s) of infringement be received regarding such user, then we may in our sole discretion opt to terminate, suspend or disable that user account.   We also reserve the right to terminate our service at any time with respect to any user that we, in our sole discretion, believe is infringing upon copyright or other intellectual property rights.

If you are the owner of a copyrighted work who believes that your rights under U.S. copyright law have been infringed by any material on our service, you can report that to us by sending the authorized DMCA agent a notification of claimed infringement (See DMCA link above). When we receive a notice of claimed infringement that satisfies the requirements of the DMCA, we will respond expeditiously to either directly or indirectly (i) remove the allegedly infringing work(s) residing on our service or (ii) otherwise comply with the DMCA process, including to disable access to the work(s) residing on our service if applicable. We will also notify the affected user when we take any of these actions.

Note: Under the DMCA, anyone who knowingly makes misrepresentations regarding alleged copyright infringement may be liable to JNPSoft and OptiCat, the alleged infringer, and the affected copyright owner for any damages incurred in connection with the removal, blocking, or replacement of allegedly infringing material.

If a user receives a DMCA notification of alleged infringement and believes in good faith that the allegedly infringing works have been removed or blocked by mistake or misidentification, then that user may send us a counter notification. When we receive a counter notification that satisfies the requirements of the DMCA, we will provide a copy of it to the person/entity who sent the original infringement notification and will follow the DMCA’s procedures with respect to received and complaint counter notifications.
